The U.S. Citizenship and Immigration Services (USCIS) will start accepting new H-1B petitions for Fiscal Year 2015 beginning April 1, 2014. The allotted quantity of H-1B petitions the USCIS need, referred to as “H-1B Cap,” is placed at 65,000, by having an additional 20,000 for people having a U.S. master’s degree or greater.  Last fiscal year, the company received greater than the allotted quantity of H-1B petitions inside the first week from the filing period.  This led to a “random selection process” or “lottery” and, consequently, a large number of H-1B petitions were rejected through the USCIS, causing employers and students to scramble to locate other visa options.  Early projections are this trend continues this fiscal year.  Therefore, employers ought to initiate h-1B process early to meet up with the filing deadline of April first.  Only individuals requiring a brand new H-1B petition are susceptible to h-1B CAP, including F-1 foreign students, foreigners presently living abroad, and people within the U.S. in another visa status for example TN or L-1.  H-1B program is required by employers to use foreigners in niche jobs that need theoretical or technical knowledge of specialized fields.
